Charge against Maksim Tikhomirov withdrawn



The charge against Maksim Tikhomirov under the Tennis Anti-Doping Programme (Programme) has been withdrawn, with immediate effect. 

Mr. Tikhomirov, a 29-year-old player from the United States, was charged with an Anti-Doping Rule Violation on 5 May 2020, in that on 28 January 2020 he evaded sample collection by allegedly (a) failing to acknowledge notification of selection for testing by failing to sign the notification form, and (b) failing to provide a sample following that notification. Evading sample collection, or (without compelling justification) refusing or failing to submit to sample collection after notification, constitutes an Anti-Doping Rule Violation under Article 2.3 of the Programme. 

Following review, it has been determined that there is insufficient evidence for the Independent Tribunal to be comfortably satisfied that a violation was committed. As a result, the charge against Mr. Tikhomirov is withdrawn. Mr. Tikhomirov, who accepted a voluntary provisional suspension on 20 May 2020, pending resolution of his case, is free to compete with immediate effect. 

In accordance with Article 8.1.4 of the Programme, this decision has been reported to WADA and Mr. Tikhomirov’s national anti-doping organisation (USADA), each of which has a right of appeal.
